Who needs to File DIR 3 KYC
In 2018, the Ministry of Corporate Affairs had introduced a new rule to the Companies (Appointment and Qualification of Directors) Rules, 2014. According to this rule, every person who holds valid Director Identification Number has to file DIR-3 KYC form with MCA. This aims to bring more glassiness and to identify the shell companies and persons by keeping the ROC Records correct and updated. DIR 3 KYC form needs to be filed annually by all the directors. DIN holder verifies the form by affixing their digital signature. Also, a practising professional has to certify the form with his/her digital signature.
In cases a director, who is supposed to file the e-Form does not file it within due date, the department will mark the DIN of such Director as ‘Deactivated due to Non-filing of DIR-3 KYC’. If the Director wishes to re-activate his DIN in future by filing the missed out eForm DIR-3 KYC, he can only submit the form after paying an additional fee of Rs 5,000. This fee would be payable on or after October 5, 2018. However, there is no fee if the DIR 3 KYC form filed within the due date.
